Effective Immediately, Michigan Issues Narrower Waivers for Licensing and Certification Requirements for Certain Health Care Professionals

On July 13, 2020, Michigan Governor Gretchen Whitmer issued Executive Order 2020-150, which rescinds Executive Order 2020-61 and orders a narrower scope of temporary relief from certain restrictions and requirements governing the provision of medical services, noting that pressure on hospitals has eased. The narrower relief includes, among other things, the suspension of requirements for exams and fingerprinting under certain circumstances, and continuing education.

The expansive waivers under Executive Order 2020-61 pertaining to scope of practice, supervision and delegation for certain licensed health care professionals, allowing certain students to work in designated facilities, and allowing out of state health care professionals to practice in Michigan, have all been rescinded. Hospitals, freestanding surgical outpatient facilities, nursing homes, hospices, homes for the aged, county medical care facilities, emergency response services, and all state-operated surgical, outpatient and veterans facilities should immediately review their current practices in light of Executive Order 2020-150 to ensure their operations are consistent with law.
