Overview

Mike Hindelang is an experienced commercial litigator whose practice has two major components. Mike has significant experience litigating high value cases, especially those with a financial or securities law component. This litigation includes minority oppression cases, shareholder disputes, high net worth trust litigation, and other commercial disputes. Mike has conducted numerous internal investigations into allegations of financial wrongdoing, as well as responding to whistleblower complaints, and government inquiries.

In addition to his litigation work, Mike is a trusted advisor to businesses on issues related to cybersecurity and privacy. Holding certifications from the International Association of Privacy Professional under both U.S. law (CIPP/US) and for privacy program management (CIPM), Mike advises clients in all aspects of their privacy programs and policies. He also leads the investigation into and response to data breaches and cybersecurity incidents, and has defended companies in response to law enforcement inquiries, shareholder class actions, and other litigation arising from these incidents.

Data, Privacy, and Cybersecurity

  • Counseled client in connection with external hacking of e-commerce platform and exfiltration of cardholder data, including subsequent forensic investigations and interfacing with Merchant Acquirer/Card Brands
  • Investigated and remediated breaches involving a variety of internal and external actors
  • Investigated, coordinated with law enforcement, and advised on civil litigation for a breach involving a hacker accessing and publicizing source code for client software code
  • Advised clients in connection with disclosure of confidential data via file systems designed to be secure
  • Advised clients regarding lost devices containing confidential or personal data
  • Counseled client in connection with external hacking of a server, which the client used to conduct security testing
  • Developed and advised in the implementation of privacy programs for clients in a variety of industries
  • Counseled clients on information management issues, including records retention policies, e-discovery protocols, and data consolidation

Litigation

  • Represented a public company in the defense of shareholder litigation seeking to enjoin a public offering
  • Represented shareholders in a variety of industries in both prosecuting and defending claims of minority oppression, breach of fiduciary duty, and related shareholder claims
  • Represented clients in numerous commercial disputes, including contract disputes, misappropriation of trade secrets claims, real estate disputes, and consumer class actions
  • Represented securities firms, at both the broker-dealer and clearing level, in customer and industry disputes
  • Represented parties, both in prosecuting and defending, regarding financial and accounting disputes, including professional malpractice allegations
  • Advised clients in responding to SEC, DOJ, IRS, and other government subpoenas
  • Assisted member firms in responding to NASD and NYSE inquiries
  • Assisted public clients in internal investigations, including in responding to whistleblower allegations
  • Represented both trustees and beneficiaries in disputes regarding trust administration
  • Represented numerous attorneys in professional disciplinary proceedings
  • Represented clients in defense of class actions in multiple subject areas, including TCPA, shareholder disputes, regulatory compliance, and others
  • Represented clients in constitutional and governmental litigation, including zoning and municipal disputes
